Please read these Terms and Conditions carefully. By accessing or using any HarmonWeb service, you agree to be bound by this Agreement.
These Terms and Conditions (“Agreement”) constitute a
legally binding agreement between
HarmonWeb Limited (“HarmonWeb”,
“Company”, “we”, “us”, or
“our”) and every customer, account holder, user, or
entity (“Customer”, “you”, or
“your”) that accesses or uses any of our services. These
services include, without limitation, shared hosting, WordPress
hosting, reseller hosting, virtual private servers (VPS), domain
registration, email hosting, and all related products, software,
support, and digital services offered by HarmonWeb.
By ordering, accessing, or using any of our Services, you
acknowledge that you have read, understood, and agreed to be bound
by these Terms and Conditions. If you do not agree to these Terms,
you must not use our Services.
For the purpose of this Agreement, “Services” means all hosting, domain, server, support, and related products provided by HarmonWeb. “Website/Server Content” means all files, data, emails, software, images, text, scripts, databases, metadata, domain names, video, audio, and other content stored on, transmitted through, or linked to your hosting account or server. “Account Information” means all registration, billing, identity, contact, and profile information supplied by you in connection with your account and any related service.
You agree to protect, defend, indemnify, and hold harmless HarmonWeb, its officers, directors, employees, agents, affiliates, customers, contractors, and administrators from and against any and all claims, liabilities, losses, damages, penalties, costs, expenses, and reasonable attorney’s fees arising out of or related to your use of the Services, your breach of this Agreement, or any act or omission by you, your customers, your agents, or anyone using your account.
This indemnity includes, without limitation, claims arising from injury to any person or property caused by any products or services sold, distributed, or made available in association with HarmonWeb Services; the loss of any electronic files, records, or materials furnished by you or your customers; copyright infringement; trademark infringement; unlawful transmission or storage of data; and any defective, illegal, misleading, or unauthorized products or services sold or promoted through your use of HarmonWeb Services.
You must provide current, complete, and accurate information for your account and, where applicable, for your domain name registrations and WHOIS records. You must maintain and promptly update such information so that it remains accurate at all times. Required information may include, without limitation, your full name, postal address, email address, telephone number, billing details, and the details of administrative, technical, and billing contacts for your domain name registrations. Where the registered name holder is an organization, association, or corporation, you must also provide the name of the authorized contact person. You further agree to provide any additional information required under applicable registrar rules, registry policies, or relevant provisions of the 2013 ICANN RAA, including data elements referenced in Subsections 3.3.1.2, 3.3.1.7, and 3.3.1.8.
The type of information required from you may change from time to time, and you agree to supply such information when requested. Failure to provide requested information may prevent you from obtaining or maintaining Services. You must update any changed information within seven (7) days of such change.
You may provide nameserver information for your domain names. If you fail to provide complete or correct nameserver information, HarmonWeb reserves the right to assign nameserver information on your behalf and to point your domain name to a website, parking page, or default location of our choosing until such time as you provide valid nameserver information. Newly registered domain names may, by default, use our nameservers and display our default parking page until changed by you through your client area or other approved management channel.
HarmonWeb reserves the right, at its sole discretion, to refuse service and/or access to its servers, systems, website, network, or support channels to any person, account, entity, or project. All Services must be used strictly for lawful purposes only. The transmission, storage, distribution, publication, linking, or presentation of any information, data, or material in violation of applicable Nigerian law or other applicable law is strictly prohibited.
You acknowledge that HarmonWeb may take immediate action, including restriction, suspension, or termination of Services, where we reasonably believe that such action is necessary to protect our business, systems, customers, upstream providers, or legal interests.
You may not use HarmonWeb Services to host, transmit, store, distribute, promote, or facilitate any illegal, abusive, fraudulent, or harmful content or activity. Prohibited material and conduct include, but are not limited to, copyrighted works distributed without authorization, commercial audio, video, or music piracy, phishing pages, scam websites, misleading or deceptive material, fake banking websites, illegal gambling content, and any material in breach of applicable regulation.
You may not host or distribute warez, pirated software, ROMs, emulators, phreaking tools, hacking tools, password cracking tools, IP spoofing tools, or encrypted archives intended to conceal any prohibited material. This prohibition also includes websites that provide links to, distribute, or publish “how-to” information relating to such prohibited activities.
Hosting IRC servers is strictly prohibited where such IRC server is part of, connected to, or has a connection with another IRC network or server. Any server or virtual hosting account found to be connected to or participating in such IRC activity may be immediately removed from our network without prior notice. Reconnection shall not occur until you have fully removed all traces of the IRC server and permitted us, if requested, to verify such removal. A second violation may result in immediate account termination.
Any form of mining activity is prohibited on our infrastructure, including but not limited to cryptocurrency mining, mining pools, blockchain mining software, and unauthorized data-mining activity. Automated bots, hate sites, child sexual abuse material, unlawful image or video distribution, phishing operations, illegal crypto investment schemes, and other fraudulent or abusive activities are likewise prohibited.
If your account is found to host multiple illegal websites or a pattern of prohibited content, HarmonWeb may close the account. If there are legitimate websites under the same account, restoration of those legitimate websites may be considered only upon payment of a reactivation fee of ₦50,000 and only if such payment is made within seven (7) days. Failing that, all hosted websites under the account may be permanently closed and blacklisted from our network.
HarmonWeb operates on infrastructure supplied by third-party providers, including but not limited to data centers, infrastructure providers, virtualization platforms, and network transit providers. Your use of our Services must therefore comply not only with these Terms, but also with the acceptable use requirements, abuse policies, technical limitations, and operational rules imposed by our upstream infrastructure providers.
Where your activity causes or is reasonably likely to cause an abuse complaint, policy breach, suspension, restriction, shutdown, blacklisting, or legal exposure with any upstream provider, HarmonWeb reserves the right to suspend or terminate your Services immediately and without prior notice. HarmonWeb shall not be liable for any loss, suspension, termination, routing issue, or service interruption that arises because of action taken by an upstream provider in response to your conduct.
HarmonWeb maintains a zero-tolerance position on abuse of its Services and infrastructure. Upon notification of an alleged violation, abuse complaint, blacklisting event, network complaint, or similar report, we may initiate an investigation and may immediately restrict access to your account, network, or services in order to prevent further harm or policy violations.
If, in our sole judgment, a violation has occurred, we may suspend, restrict, or terminate the relevant service or account. We also reserve the right to pursue civil remedies for the costs of investigating and responding to substantiated violations. Where we believe a matter may amount to a criminal offense, we may notify law enforcement or relevant authorities.
Failure to respond within the time specified in an abuse notice may result in automatic continuation of the suspension or permanent termination of the affected service.
Use of our Services to send unsolicited commercial email or unsolicited bulk email (“SPAM”) is expressly prohibited. You may not use our network or Services to send spam directly or indirectly, nor may you host websites, applications, or services that support spammers, facilitate spam campaigns, or cause any portion of our IP space to be listed in spam blocklists or reputation databases.
If your use of the Services leads to listing of any of our IP addresses in any spam database, blacklist, or reputation system, your account may be suspended immediately. In addition, an administrative fee of ₦100,000 may be charged for a first substantiated offense. The account shall not be restored until you have removed all traces of the offending material, mailing system, or abuse source to our satisfaction. First violations may result in a warning and review for possible immediate termination. A second violation may result in immediate termination, and the administrative fee for the repeated violation may be ₦200,000. Severe violations may result in immediate and permanent removal of the account from our network without notice.
We also maintain zero tolerance for posting messages or commercial advertisements that violate the rules, regulations, or charter of any mailing list or newsgroup. Commercial messages are only permitted where they are allowed under the applicable rules of the mailing list or newsgroup and have been affirmatively solicited by the recipient.
Hosting a publicly accessible open relay SMTP service or anonymous remailer service for any purpose whatsoever is strictly prohibited.
HarmonWeb offers a range of hosting services. Web Hosting includes Shared Hosting and WordPress Hosting. Where you purchase Web Hosting, your site is placed on one or more servers where resources are shared among multiple customers, although your site is assigned its own DNS identity and hosting environment.
Where you purchase a VPS service, you are provided with a virtualized server environment on shared hardware, with control over the virtual instance, root or administrator access, and a dedicated IP address where applicable. VPS services provide greater autonomy, but also impose greater responsibility on the customer for configuration, management, and security.
You acknowledge and agree that, as part of ordinary business operations, maintenance, growth, abuse prevention, security work, infrastructure changes, or provider-level changes, HarmonWeb may migrate services between servers, data centers, or platforms. As a result, even where a service includes a dedicated IP address, that IP address may change. HarmonWeb does not warrant that any assigned IP number shall remain permanently the same.
Upon expiration, cancellation, suspension, or termination of any Service, you must immediately discontinue use of that Service and relinquish all rights to the IP addresses, server names, DNS allocations, and related resources assigned to you in connection with the Service. Before cancellation or termination, you are solely responsible for migrating your website or server content off our systems. HarmonWeb is under no obligation to transfer, copy, package, email, or FTP your content to you or to another provider.
If you fail to move your website or server content before cancellation or termination, your content may be permanently deleted and may not be recoverable. HarmonWeb shall have no obligation to retain or provide a copy of deleted data after termination.
You are solely responsible for taking all reasonable measures to prevent loss of, or damage to, your website or server content, for maintaining independent archival and backup copies of your content, and for ensuring the security, confidentiality, and integrity of all materials transmitted through or stored on our systems.
HarmonWeb may provide backups as a courtesy only. Our backup service may run once weekly and overwrite previous backups. Ordinarily, only two weeks of backups may be stored on the remote backup server. If daily backups are included in your plan, the last week’s daily backups may additionally be stored. This backup service may be modified, restricted, or withdrawn at any time in our sole discretion.
Any cPanel shared hosting account using more than 10GB of disk space may be removed from our off-site weekly backup system. To remain eligible for continued backup generation under that backup scheme, you must ensure that your disk usage does not exceed 10GB. HarmonWeb is not responsible for files and/or data residing on your account, whether or not any courtesy backup exists.
Our servers are not intended to function as archives or generic storage repositories. You may not use a hosting account as online storage for archived electronic files, nor as a repository for files intended primarily for download through other websites. We reserve the right to delete archives or stored materials that affect server performance, and HarmonWeb shall have no liability to you or any third party for loss, destruction, or corruption of such content.
You must not use the Services in any manner that impairs the function or operation of HarmonWeb’s systems or any equipment used to provide the Services.
Where we detect misuse of email storage, a warning may be issued when email storage reaches 5GB, and you may be required to reduce usage. HarmonWeb also reserves the right to temporarily suspend disk-write functionality, in our sole discretion, once email storage reaches 5GB.
You acknowledge and agree that HarmonWeb may conduct a forensic examination of your account or server where compromise, abuse, malware infection, or unauthorized activity is suspected.
By using our shared hosting services, you acknowledge and agree that HarmonWeb may use automated security tools, including Imunify360 or similar software, to scan, quarantine, clean, and delete malicious files for the protection of our systems and customers. Such tools may automatically remove detected malware from your files without prior notice.
You are responsible for ensuring that malicious files are not uploaded to or hosted on your account. Hosting malicious files is strictly prohibited and may result in interruption of your website or service where infected files are removed. Repeated malware incidents, repeated compromise, or ongoing security negligence may lead to suspension or termination of the hosting account. We strongly recommend that you maintain regular security practices, updates, audits, and independent backups to minimize service disruption.
You are solely responsible for managing your website or server and for all content associated with it, including the uploading, installation, updating, maintenance, transmission, and publication of all files, software, scripts, databases, images, graphics, messages, trade names, service marks, domain names, audio, video, emails, text, and related material. You are responsible for ensuring that your content and usage comply with all applicable laws, regulations, third-party rights, and these Terms.
You acknowledge and agree that our support staff may, where necessary in connection with technical assistance or abuse remediation, modify, alter, disable, quarantine, or remove content from your hosted product. Website or server content also includes domain names supplied by you or registered on your behalf in connection with the Services.
All hosting plans, including plans advertised with unlimited or unmetered features, remain subject to technical and operational limits. Such limits may include, without limitation, inode count, database size, CPU allocation, RAM allocation, entry processes, active processes, disk I/O, and other resource restrictions.
Where such plan limitations are exceeded, you may be required to reduce files, optimize databases, reduce resource usage, or upgrade to a higher plan. Your site may slow down, fail to serve properly, or be temporarily or permanently suspended until usage is brought within acceptable limits or additional resources are provisioned. HarmonWeb reserves the right to change plan limits from time to time and to post such changes on its website or client interfaces. You further acknowledge and agree that inbound UDP is not supported in shared hosting environments.
Shared hosting is intended for standard website and business use cases and may not be used for activities that, in our judgment, are excessively resource-intensive, abusive, insecure, or incompatible with the shared environment. This includes, without limitation, public file-hosting platforms, large-scale streaming services, persistent background daemons, aggressive automation, cryptocurrency-related processing, anonymization platforms, or workloads more appropriate for isolated server infrastructure. HarmonWeb may require migration to VPS or may suspend incompatible workloads where needed to protect server performance and other customers.
HarmonWeb may offer free domain registration with selected yearly hosting plans. Such free domain offers apply only to eligible packages and only for the first year of registration; renewals are not included. Eligible free extensions may include .com.ng, .org.ng, .ng, and any other extensions expressly stated in the offer at the time of purchase. The specific extension available for free depends on the package purchased.
To qualify, the domain must be ordered together with the eligible hosting package at the time of purchase. The free domain must remain attached to, and function as, the primary domain of the associated hosting account for as long as the domain remains under the free-offer arrangement. You agree that you may not transfer the domain to another registrar while it remains under the free-offer arrangement unless you first pay the applicable domain registration fee. If you do not order the free domain together with the qualifying hosting plan at signup, you may not later claim the free domain benefit separately.
The free domain offer referenced in some plans may include one free .COM, .ORG, .COM.NG, .ORG.NG, .XYZ, or other stated extension, but only where expressly included with the qualifying yearly plan. Free domain eligibility is limited to yearly hosting plans.
HarmonWeb provides support through designated channels and within the scope defined for each service type. Support is available 24/7 through email and ticket. Live chat and WhatsApp support are available during business hours from 7:00 AM to 5:00 PM, Monday to Friday, and from 12:00 PM to 6:00 PM on Saturday and Sunday.
While response times are targets rather than guarantees, we aim to respond to critical issues within 10 minutes, high-priority issues within 30 minutes, medium-priority issues within 1 hour, and low-priority issues within 3 hours.
For Shared Hosting, support generally includes assistance with server uptime and performance issues, basic email configuration and troubleshooting, basic DNS setup and issues, control panel guidance, and basic website setup assistance. Shared Hosting support does not include in-depth troubleshooting of third-party applications or scripts, website design or development, custom coding, advanced database troubleshooting or optimization, or WordPress error troubleshooting.
For WordPress Hosting, support includes all aspects of shared hosting support together with assistance relating to installation and configuration of WordPress, installation of themes and plugins, troubleshooting of WordPress-specific issues, guidance on WordPress performance and security best practices, and assistance with WordPress backups and restores. Eligibility for WordPress technical support is limited to customers on a WordPress Hosting plan. Customers on Shared Hosting who require WordPress-specific support may be required to upgrade to a WordPress Hosting plan to receive such support.
Customers using VPS or similar unmanaged or semi-managed services are fully responsible for server configuration, software installation, operating system maintenance, security hardening, software updates, access control, and abuse prevention, except to the extent a separate managed service is expressly included in writing. Any abuse, compromise, malware activity, spam, or unlawful conduct originating from a VPS shall be treated as the responsibility of the VPS customer.
If payment is made by credit card, debit card, or PayPal, the account may be set up as soon as payment is confirmed. The 14-day money-back guarantee applies only to first-time signups for eligible hosting services. Second-time and subsequent signups are not eligible. By way of example, if you previously had an account, canceled it, and signed up again, or if you open an additional account after previously having hosted with us, you will not qualify for the refund guarantee on that subsequent signup.
No refunds shall be given for domain registration, domain transfer, domain renewal, cPanel licenses, Plesk licenses, Webuzo, control panel licenses, cloud services, VPS, dedicated servers, paid support, SSL certificates, SpamExperts, Windows operating systems, SQL-related licensing, or any other paid license or third-party software or service.
The money-back guarantee applies only to Shared Hosting, WordPress Hosting, and Email Hosting, and does not apply where your Services have been suspended or terminated for cause. Refunds do not include taxes, setup fees, refund processing fees, or any amounts excluded because of Terms violations, illegal usage, excessive resource abuse, requests made after the 14-day period, or situations outside the stated refund coverage.
HarmonWeb may from time to time offer discounts, promotions, introductory pricing, or special offers. Such promotional pricing is limited to the initial term only unless expressly stated otherwise. Discounted prices do not apply to renewals, and upon completion of the initial term, the service will automatically renew at the regular applicable rate then in effect.
Unless expressly stated otherwise, all prices for web hosting, domain registration, and related services are exclusive of Value Added Tax (VAT). VAT shall be added to invoices at the applicable rate in accordance with the laws and regulations governing the transaction or the customer’s business jurisdiction, where applicable.
It is your responsibility to understand any VAT obligations applicable to your purchase. The total amount charged, including VAT, shall be reflected on the invoice. HarmonWeb reserves the right to adjust the VAT applied to your invoice in the event of a change in law, tax policy, regulatory guidance, or applicable tax rate. If your business qualifies for exemption or special tax treatment, it is your responsibility to provide valid supporting documentation at the time of purchase.
Cancellation requests must be submitted through the client area by using the cancellation option under the relevant product or service. Cancellation requests submitted solely by ticket, email, or other informal channels may not be treated as valid cancellation instructions. After a valid cancellation request is submitted, processing may take approximately 4 to 5 hours.
Before termination, you are strongly advised to make complete backups of your files and data. HarmonWeb shall not be responsible for loss of data after termination. While there may be temporary backups available for up to 24 hours after termination through JetBackup or similar tooling, such availability is not guaranteed and should not be relied upon.
Where the hosting service included a free domain name, cancellation of the hosting service shall result in the standard domain registration charge being deducted from any eligible refund. If the refundable amount is less than the domain name charge, you must either pay the difference or forfeit the domain. If you fail to pay the difference, ownership and control of the domain may remain with HarmonWeb until all applicable amounts are settled.
Transfer fees may apply if you wish to transfer a free domain to another provider. The domain will not be released until any applicable transfer or registration charges are paid. Refund requests made after 14 days from service activation are not eligible for processing. Where a refund is approved, you acknowledge that although the refund may be issued promptly by the merchant, visibility of the refund in your bank or card statement may take approximately 3 to 14 days depending on the card issuer, banking system, acquirer workflow, and batched settlement cycle.
A hosting account suspended due to an overdue invoice must ordinarily be renewed within 14 days from the date of suspension. If the hosting account remains unpaid after that 14-day period, a redemption fee of ₦1,000 may be added to the renewal invoice in order to retain the website backup on our servers for an additional 16 days. If payment is not received within that additional period, the hosting account and all associated backups may be automatically terminated and shall no longer be renewable.
Once such deletion has occurred, all files, data, emails, and other content may be permanently lost and may not be recoverable. This same timeline may also apply, in HarmonWeb’s discretion, to services suspended for violation of these Terms. If your service is suspended for a policy violation, you must contact us within 14 days to seek resolution; otherwise, the service may be terminated from our servers.
HarmonWeb shall not be liable for downtime, routing issues, hardware problems, upstream network failures, provider-level suspensions, maintenance events, or other interruptions caused in whole or in part by third-party infrastructure providers, data centers, registries, or external service vendors. You acknowledge that the availability of your services may depend on systems outside HarmonWeb’s direct control.
To the maximum extent permitted by applicable law, HarmonWeb shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, revenue, data, business opportunity, goodwill, business interruption, or anticipated savings, whether arising in contract, tort, negligence, strict liability, or otherwise, even if advised of the possibility of such damages.
In all cases, HarmonWeb’s total aggregate liability arising out of or relating to the Services shall not exceed the amount actually paid by you to HarmonWeb for the specific affected Service during the billing period immediately preceding the event giving rise to the claim, except where such limitation is prohibited by law.
HarmonWeb reserves the right to refuse, cancel, suspend, restrict, or modify any Service at its sole discretion. HarmonWeb further reserves the right to amend, modify, update, or replace these Terms and Conditions at any time. The most current version published on our website shall govern your continued use of the Services, and all customers shall be bound by the newest published version.
Continued use of the Services after any such update constitutes your acceptance of the revised Terms.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute arising from or relating to these Terms or the Services shall be subject to the applicable jurisdiction and legal processes recognized under Nigerian law, unless otherwise required by mandatory law.
